H1-B VISA New Reforms What the Real Fuss?

04:52
H1-B VISA New Reforms What the Real Fuss ? What is H1-B? US entry pass for skilled foreign people, like scientists, engineers or computer programmers How long they can stay ? 3 Years, can be extendable 6 Years How skilled foreign nationals per year? current limit 65,000 people Do they pay tax ? H1-B employees have to pay Social Security and Medicare taxes How the visa are awarded ? Visa are Can they bring some one ? H1-B visa can bring Immediate family members. spouse and children under 21 years What is the fuss about ? New proposal to tighten the abuse of H1-B visas. And save more jobs for USA citizens What are the proposals ? #1 Increase H1-B visa processing fees. $4000 company having H-1B employees less than $100,000 Pay, Have to explain why they cannot hire Americans. any company paying H-1B workers less than $100,000 would have to show they couldn't hire Americans for the same jobs. More taxes for companies outsourcing work outside USA India, Chain, etc Scrap lottery system, and propose new scheme Duration of stay The duration of stay is three years, extendable to six years. An exception to maximum length of stay applies in certain circumstances: Congressional yearly numerical cap and exemptions The current law limits to 65,000 the number of foreign nationals Social Security and Medicare taxes H1-B employees have to pay Social Security and Medicare taxes as part of their payroll Dependants of H-1B visa holders H1-B visa holders can bring immediate family members spouse and children under 21 to the United States under the H-4 visa category as dependants. Trump senior policy adviser Stephen Miller proposed scrapping the existing lottery system used to award the visas. A possible replacement system would favour visa petitions for jobs that pay the highest salaries, according to the sources. These are intended for foreign nationals in "speciality” occupations that generally require higher education, which according to US Citizenship and Immigration Services USCIS includes, but is not limited to, scientists, engineers or computer programmers. The US government awards 65,000 every year. Companies say they use these to recruit top talent. But, a majority of the visas are awarded to outsourcing firms, sparking criticism by sceptics that say those firms use the visas to fill lower-level IT jobs. Critics also say the lottery system benefits outsourcing firms that flood the system with mass applications. The H1B visa programme tends to be more critical to outsourcing firms than US tech firms. In several high-profile cases, American workers were asked to train H1B holders to do their jobs before being laid off themselves What Mr.Donald Trump Said so for? "I will direct the Department of Labor to investigate all abuses of visa programs that undercut the American worker.” "end forever the use of the H-1B as a cheap labor program.” "very, very bad for workers,” and the U.S. "should end it.” "You can’t allow policies that allows China, Mexico, Japan, Vietnam, India. You can’t allow policies that allows, business to be ripped out of the United States like candy from a baby.” What Next? Indian companies may acquire American startups and recruit more heavily form college campus More virtual services offered to American companies trhough AI and Automation. companies may setup entire divisions abroad rather fighting for visas More startups may move to India and China Tech workers and immigration experts are very much taking a "wait and see" approach. According to the National Foundation for American Policy, more than half of all US technology startups are founded by immigrants. What the affecting people saying? "There are two possibilities. One with regard to the fee. The second is the number of visas. We are addressing both proactively" - N Chandrashekaran - Chairman, TCS "We expect there will be changes in policy, when the administration starts next week. We will address the issue as we learn more" - Vishal Sikka CEO, Infosys "technology companies need to be able to recruit talent from abroad when necessary". - Mr. Satya Nadella,CEO Microsoft "The macro trend that's really important is that we, as a country, acknowledge how much value is created by so many immigrants." - Mr.Alexis Ohanian,Reddit co-founder
